General Terms and Conditions for Promotions and Competitions | Rhodes Quality
  1. These general conditions for promotions/special offers and competitions (hereinafter the “Terms and Conditions Competitions’) apply to competitions and other promotional activities organized by Rhodes Food Group Holdings (Pty) Ltd (Registration No: 2012/074402/07 (“Organizer”). These terms are to be read in conjunction with any specific competition rules set out for each competition and/or promotion.
  2. By participating in any Competition and/or promotion (“the Competition”) you agree to these Competition rules (“Rules”) and to our Privacy Policy and agree to abide by both. Any person failing to comply with these Rules will not be entitled to participate in any Competition or will be disqualified from the Competition. Our Privacy Policy is available.
  3. The Competition is in no way sponsored or endorsed by any party other than the Organizer.
  4. The Competition is open to SA residents aged 18 or above only and all participants may be required to show valid identity documents as proof thereof.
  5. No persons who are directors, members, partners, employees, or agents of, or consultants to, the Organiser and/or its parent or affiliated companies, their marketing service provider(s) utilized in connection with the Competition, any supplier of goods or services in connection with the Competition, any other person who directly or indirectly controls, or is controlled by, them, or any spouse, life partner, parent, child, brother, sister, business partner or associate of any of such persons, may enter the Competition.
  6. To enter, participants must use entry mechanism specified on the Competition entry form / box.
  7. Incomplete, late, or otherwise faulty entries will not be accepted.
  8. Once a winner is chosen and If any winner cannot be reached after 6 attempts have been made during business hours within a period of 72 hours for any reason whatsoever, the prize will be forfeited and another winner will be selected in accordance with the competition rules
  9. All winners will need to identify themselves with a bar coded South African ID book. The drawn winners, once contacted, will have 5 working days to forward all the required documentation to the organisers. If the winner does not provide the documents within the prescribed time, then he/she will forfeit the prize and another winner will be selected in accordance with the competition rules.
  10. The prize is not transferable, is non-refundable, non-exchangeable and cannot be redeemed for cash. To the maximum extent permitted in law, the Organiser excludes liability for any defects in the prize.
  11. The Organiser’s decision is final and no correspondence will be entered into.
  12. The Organiser will not be held responsible for any direct, incidental or consequential loss or damage that any winner could incur in relation to any information which the organiser provides to the prize sponsor in relation to the competition.
  13. Where an entrant or prize winner has been found to be in breach of any of the terms and conditions of the Competition, we may enforce our right to disqualify that person and require the return or reimbursement to us of any prize even where a prize has been awarded and/or actually provided to the entrant or prize winner in question.
  14. The Organiser reserves the right to terminate or temporarily suspend the Competition in the event of technical or other difficulties that might compromise its integrity.
  15. The Organiser and their agents accept no responsibility for difficulties experienced in submitting an entry to the Competition.
  16. Unless otherwise advised, the Organiser will be responsible for distributing the prizes to the relevant winners and will do so via a reputable courier. The Organiser will supply all prizes to the delivery company in good order, but will not be held liable for the condition of the packages arriving at the winners’ chosen delivery address.
  17. The winner’s chosen delivery addresses may not be a postal address and the winner must be available to sign and take receipt of the package. Please allow 6 – 8 weeks for delivery from the date of contact for the prize to be delivered.
  18. If a participant has won a prize from the Organiser in the last two months, he/she is ineligible to win another prize until the two month period is completed.
  19. To the maximum extent permitted in law, the Organiser and its directors, officers, managers, employees and agents, shall not incur any liability to any person for any injury, claim, loss or damage of any nature whatsoever, whether direct, indirect, consequential or otherwise, as a result of entering into, or arising from any cause whatsoever or howsoever arising from their participation in, the Competition or the use of any prize won thereunder (any such prizes being utilized at the own risk of any winner thereof).
  20. In the event of a dispute in respect of any aspect of the Competition, the Organiser’s decision is final and no correspondence will be entered into.
  21. By entering the Competition you authorize the Organiser to collect, store and use (not share unless specified otherwise) personal information of Participants for marketing, communication or statistical purposes. You are entitled to decline any marketing communication by emailing. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and the Organiser’s privacy policy. The Organiser may share your personal information with a co-sponsor/partner of the Competition as specified on the Competition entry form. The winner or participants may be requested to take part in publicity campaigns for broadcast or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Organiser.
  22. The Organiser does not sell or rent personal information about individual members to third parties. We may, however, disclose personal information in response to a specific request by a law enforcement agency, subpoena, court order, or as required by law.
  23. The Competition shall comply with, and will be subject to, any peremptory provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and the regulations promulgated thereunder, which are deemed to be incorporated herein (“Peremptory Provisions”). In the event of any conflict between these Rules and the Peremptory Provisions, the latter shall prevail.   24. Any provision of these Rules or the Competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions thereof.
  25. The laws of the Republic of South Africa govern these Rules and participants agree to be subject to the exclusive jurisdiction of the South African courts.
  26. When the General and/or specific Terms and Conditions differ from those determined in the Specific Terms and Conditions of any Competition and/or promotion, the specific Terms and Conditions prevail.
  27. In the event of a dispute in respect of any aspect of the Competition, the Organiser’s decision is final and no correspondence will be entered into.
  28. Actual prizes may differ from those depicted in the promotional posters/ Product images are for illustrative purposes only and may differ from the actual product.
  29. These terms and conditions are subject to change without notice, from time to time in our sole discretion
  30. Competition closes at midnight on the 18th April 2018. Winners will be announced on the 23rd April 2018.
